1. This Website is set up for the sole purpose of the prospective sale of Verano (the “Development”). Joyful Colour Limited is the vendor of the Development (the “Vendor”). The Vendor sets up this Website for collecting personal data (collectively “Personal Data”) solely for the purposes of direct marketing the Development to potential purchasers and others who wish to receive promotional materials or to participate in promotional activities relating to the Development (the “Direct Marketing Purposes”).
2. Because this Website and collection of Personal Data is solely and specifically for Direct Marketing Purposes, by providing your Personal Data and pressing SUBMIT on this Website, this amounts to giving express and voluntary consent to the Vendor to use and process your Personal Data for Direct Marketing Purposes in accordance with the terms of this Statement. If you do not wish to receive promotional materials or to participate in promotional activities relating to the Development, please do not provide any Personal Data.
3. Your Personal Data will be used for the following Direct Marketing Purposes:-
   
   • Sending you information and promotional materials in relation to the sale of the Development, on the understanding that the arrangement in respect of such sale shall be subject to the sole discretion of the Vendor; and
   • Sending you invitations or making arrangements for promotional activities, for the Development.
4. You understand and agree that the Vendor may share or transfer your Personal Data in the following circumstances:-
   
   • The Vendor may share or transfer your Personal Data to any agent, contractor, representatives or third party service provider assisting the Vendor in performing the Direct Marketing Purposes.
   • The Vendor may share or transfer your Personal Data to any agent, contractor or third party service provider who provides administrative, telecommunications, computer or other services to or who supports the operation of the Vendor’s business.
   • If any Vendor is involved in any actual or potential transfer of the Development or its business or shares, or is involved in any merger, acquisition, amalgamation or reorganization, the Vendor may share or transfer your Personal Data to the relevant third party involved in such arrangements.
   • The Vendor may share or transfer your Personal Data to the relevant government or law enforcement agencies, regulatory authorities, courts or judicial bodies, or other persons where necessary to (i) comply with any applicable law or regulation, (ii) exercise, establish or defend legal rights, or (iii) protect your or any other person's important legitimate interests.

   The above persons to whom your Personal Data may be shared or transferred may be located outside of Mainland China (as defined below) or Hong Kong. The data protection laws and regulations in these jurisdictions may differ from those in Mainland China or Hong Kong.

   Except as set out above, the Vendor will not transfer your Personal Data to any other person without your consent.

5. You may require the Vendor at any time to cease using your Personal Data for Direct Marketing Purposes and the Vendor must so cease, without charge.
6. The Vendor will keep your Personal Data only for so long as necessary to fulfil the Direct Marketing Purposes. Upon fulfilment of the Direct Marketing Purposes, or if you require the Vendor to cease to use your Personal Data for Direct Marketing Purposes at any time, the Vendor will delete your Personal Data as soon as reasonably practicable.
7. You may at any time request access to and/or to correct your Personal Data in the Vendor’s To exercise these rights, you may contact the Vendor at the address below, marking your communication "Confidential".  If you would like to (1) request for (i) access to data or correction of data and/or (ii) general information regarding the Vendor’s policies and practices with respect to personal data and (2) raise general enquiries and complaints about the Vendor’s handling of personal data for Direct Marketing Purposes, such requests, enquiries and complaints should be addressed to:

8. In addition to your right to access and/or correct your Personal Data set out above, if you are an individual who resides in Mainland China, you have the following rights in relation to your Personal Data in accordance with the personal information protection laws and regulations of Mainland China:
   1. You have the right to withdraw your consent to the processing of your Personal Data (where your consent is required for such processing). The withdrawal of consent does not affect the validity of the processing activities that have been carried out based on your consent before the withdrawal. 
   2. You have the right to request the Vendor to transfer your Personal Data to another party designated by you. 
   3. You have the right to request the Vendor to delete your Personal Data in specified circumstances. 
   4. You have the right to complain and report illegal processing activities to the relevant regulatory authorities. 
   5. If you wish to exercise your rights, please contact the Vendor through the contact information set out above. The Vendor will respond to your request in accordance with the response timeline and other requirements prescribed by the applicable laws and regulations.
9. To the extent required or permitted by laws or regulations, the Vendor may be unable to respond to your request to exercise your rights in the following circumstances:
   1. If your request is contrary to the fulfilment of the Vendor’s obligations under laws and regulations.
   2. If the requested information is directly related to national security and defence security.
   3. If the requested information is directly related to public safety, public health, or significant public interest.
   4. If the information requested is directly related to criminal investigations, prosecutions, trials or enforcement of sentences.
   5. If the requested information involves trade secrets.
   6. If responding to your request will result in serious damage to the legitimate interests of others.
   7. If the Vendor has sufficient evidence of subjective malice or abuse of rights on your part.
10. For the purpose of this Statement, “Mainland China” refers to the People's Republic of China excluding the Hong Kong Special Administrative Region, the Macau Special Administrative Region and Taiwan.
11. This Statement may be updated from time to time. The Vendor will inform you of the changes to this Statement and obtain your consent for any material changes as required by applicable data protection laws.
